Important: Website content is preliminary information, not a title certificate, valuation, sanctioned plan, legal opinion, investment recommendation or binding offer. Every property decision should follow independent legal, technical, financial and regulatory due diligence.

1. Acceptance and eligibility

These Terms and Conditions (“Terms”) govern access to this website and interactions with Pro Property Connect through the website, telephone, WhatsApp, email, Cal.com or a site visit. By using the website or submitting an enquiry, you confirm that you have read and accepted these Terms and our Privacy Policy.

You must be at least 18 years old and legally competent to contract under applicable Indian law. If you act for a company, trust, Hindu undivided family, partnership, property owner, buyer or another person, you represent that you have authority to do so. If you do not agree with these Terms, do not use the website or rely on its content.

These Terms concern website use and preliminary advisory interactions. A separately signed mandate, brokerage letter, confidentiality agreement, booking form, agreement for sale, lease, sale deed or other transaction document will govern the matters specifically covered by that document. If there is a conflict, the signed transaction-specific document prevails for that subject.

2. Our role and service boundaries

Pro Property Connect provides real estate introduction, sourcing, marketing support, coordination and advisory services. Depending on the written mandate, we may assist with shortlisting, owner or developer introductions, site visits, negotiation support, document coordination and transaction follow-through.

Unless expressly stated in writing for a particular property, we are not the property owner, promoter, developer, landlord, lender, insurer, architect, structural engineer, valuer, advocate, chartered accountant or government authority. We do not execute a transfer on behalf of a party unless separately and lawfully authorised.

General statements about title checks, legal support, investment, Vastu, FEMA, taxation, finance, construction, development potential or documentation describe the type of coordination we may offer. They are not a substitute for advice or certification from an independently appointed qualified professional.

3. Property listings, measurements and availability

Property information may be supplied by an owner, promoter, developer, authorised representative, public record or other source. We take reasonable care when presenting a mandate, but property facts remain subject to documentary verification, physical inspection and confirmation by the relevant party or authority.

  • Availability, possession status, specifications, furnishings, access, orientation, amenities and transaction terms may change without notice.
  • Plot, carpet, built-up, super built-up and construction areas may use different measurement conventions. Figures described as approximate are estimates and must be independently measured and checked against sanctioned and title documents.
  • Photographs may show occupied premises and movable items that are not included in a transaction. Image colour, perspective and cropping may differ from an in-person view.
  • A reference to a clear title, ready-to-move status, approval, construction or use is not a warranty and remains subject to legal and authority verification.
  • Pricing, taxes, stamp duty, registration charges, brokerage, maintenance, transfer fees and other costs may be separate unless expressly stated in writing.

No offer or reservation

A website listing, phone conversation or message is an invitation to enquire and not an offer capable of acceptance. A property is not reserved, sold, leased or taken off the market merely because you enquire, visit, negotiate or express interest. A binding obligation arises only through duly executed documents between competent parties and satisfaction of their stated conditions.

RERA and Gujarat requirements

The Real Estate (Regulation and Development) Act, 2016 requires registration of specified real estate projects and real estate agents and regulates their functions. For a transaction to which the Act applies, users should obtain the relevant project and agent registration particulars and independently verify current information through the Gujarat Real Estate Regulatory Authority.

Some resale properties, completed properties, small developments or other transactions may fall outside particular project-registration requirements or may be subject to an exemption. The appearance of any property on this website should not be interpreted by itself as a representation that RERA registration is required, exempt or complete. Applicable status must be checked for the specific property and transaction.

4. Independent property due diligence

Before signing or paying any amount, a buyer, tenant or investor should appoint suitable independent professionals and verify all matters material to the transaction. Depending on property type, these may include:

  • ownership, title chain, tenure, mutation and revenue records, encumbrances, charges, liens, litigation, succession, powers of attorney and authority to sell;
  • survey, boundaries, access, plot and built-up measurements, easements, rights of way and possession;
  • NA permission, zoning, town-planning scheme, final plot status, reservations, road lines, development potential and applicable AUDA, AMC or other authority requirements;
  • sanctioned plans, commencement and completion permissions, building-use permission, fire and environmental requirements, unauthorised construction and structural condition;
  • GujRERA registration and disclosures where applicable, promoter history, approved specifications and possession commitments;
  • society, association or condominium records, share certificate, transfer permission, maintenance dues, common-area rights and restrictions;
  • property tax, electricity, water, loan, maintenance and other outstanding dues;
  • stamp duty, registration fee, GST, withholding tax, capital-gains and other tax consequences;
  • insurance, valuation, rental yield, financing eligibility and commercial suitability.

Any document summary or coordination provided by us is limited to the agreed scope and does not shift the user’s responsibility to obtain an independent written legal title opinion, technical inspection and financial advice.

5. Enquiries, site visits, fees and payments

Accurate enquiry information

You agree to provide accurate contact and requirement details, update material changes, communicate lawfully and not impersonate another person. We may decline an enquiry where information is misleading, authority is unclear, conduct is abusive, or the proposed activity appears unlawful.

Private and occupied properties

Site visits are by appointment and subject to owner or occupant approval. You must follow reasonable security, access, photography, confidentiality and safety instructions. Property addresses, owner information, documents, photographs and off-market details supplied privately must not be published, circulated, scraped or used to bypass an agreed introduction.

Fees and brokerage

Any advisory fee, brokerage, commission, retainer, success fee, reimbursement, cancellation term and applicable tax will be disclosed separately for the relevant mandate or transaction. Unless expressly agreed in writing, website access and an initial enquiry do not fix a fee or create an exclusive mandate.

Tokens, deposits and transaction money

Do not make a token, booking amount, deposit or property payment solely on the basis of website content or an informal message. Confirm the recipient’s identity and authority, obtain written terms and an official receipt, and take independent advice before payment. Refundability, forfeiture and adjustment depend on the applicable written document and law. We are not responsible for money paid directly to an owner, promoter, developer or third party unless we expressly acknowledged receiving that amount in writing.

6. NRI, finance, tax and investment matters

References to NRI support, powers of attorney, FEMA coordination, repatriation, taxation, yield or appreciation are general service descriptions. Eligibility to acquire, hold, lease, sell or repatriate proceeds depends on citizenship, residency, property classification, funding route, banking records and law applicable at the time.

NRIs and overseas clients should obtain advice from an Indian advocate, chartered accountant and authorised dealer bank concerning the Foreign Exchange Management Act, Reserve Bank of India directions, income-tax withholding, capital gains, remittance and power-of-attorney requirements.

Property is illiquid and subject to legal, title, market, construction, counterparty, financing, tax and regulatory risk. Historical prices, expected appreciation, rental yield or corridor-development statements are not guaranteed returns or financial advice.

7. Website use, communications and intellectual property

You may use the website for personal, lawful property enquiry purposes. You must not:

  • copy, republish, sell, commercially exploit or systematically download listings, images, text, branding or private property information;
  • scrape, crawl or use automated tools in a manner that burdens the website or builds a competing database;
  • introduce malware, bypass security, probe systems, interfere with operation or attempt unauthorised access;
  • submit false enquiries, spam, harass any person, infringe privacy or intellectual-property rights, or use the website for unlawful activity.

The website design, text, graphics, logo, arrangement and original media are owned by or licensed to Pro Property Connect and protected by applicable intellectual-property law. Property photographs may also belong to owners or content providers. No right is granted except the limited right to view the website for its intended purpose.

Electronic communications

You consent to receiving responses and transaction-related communications electronically at the phone number, WhatsApp account or email address you provide. Electronic records and communications may be used subject to the Information Technology Act, 2000 and other applicable law. You are responsible for protecting access to your devices and accounts.

Third-party services

Links and embedded services such as Cal.com, Google Maps, Firebase and WhatsApp are provided for convenience and operate under third-party terms. We do not control their availability, security or independent content.

8. Disclaimers, liability and indemnity

The website and preliminary information are provided on an “as available” basis. To the extent permitted by law, we do not warrant uninterrupted operation, error-free content, availability of any property, successful negotiation, financing, legal approval, title quality, possession date, return, appreciation or completion of a transaction.

To the extent permitted by applicable law, Pro Property Connect will not be liable for indirect, incidental, special, punitive or consequential loss, loss of opportunity, profit, rent, data or goodwill arising from website use, third-party acts, reliance on unverified property information, or a transaction that does not complete. Our aggregate contractual liability arising from a separately paid advisory service will not exceed the advisory or brokerage fee actually paid to us for the specific service giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded, limits rights available under the Consumer Protection Act, 2019 or RERA, or excuses fraud, wilful misconduct, gross negligence or breach of a mandatory statutory duty.

You agree to indemnify us against third-party claims, losses and reasonable costs caused by your unlawful use of the website, false information, lack of authority, infringement, breach of confidentiality or material breach of these Terms. This obligation does not apply to the extent a claim was caused by our own unlawful conduct.

Events beyond reasonable control

No party is responsible for delay caused by events beyond reasonable control, including authority restrictions, court orders, natural events, utility or internet failure, civil disturbance, epidemic, banking disruption or third-party platform outage, except for obligations that applicable law does not permit to be excused.

9. Governing law, complaints and disputes

These Terms are governed by the laws of India and applicable laws and regulations in Gujarat. Courts of competent jurisdiction in Ahmedabad, Gujarat will have jurisdiction over disputes relating to website use or our services, subject always to any mandatory forum or remedy available under RERA, consumer-protection law or other applicable legislation.

Before starting ordinary civil proceedings, the parties should attempt in good faith to resolve the issue through written discussion for at least 30 days after a detailed complaint is received. This does not prevent urgent interim relief, a statutory complaint, or proceedings before GujRERA, a consumer commission or another authority with jurisdiction.

If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a right is not a waiver. We may update these Terms for future use of the website; the current version and effective date will appear on this page.

Official regulatory references

Authoritative information is available from GujRERA, the Real Estate (Regulation and Development) Act, 2016, the Transfer of Property Act, 1882, the Registration Act, 1908 and the Consumer Protection Act, 2019.

10. Contact and grievance handling

Send questions, complaints or legal notices concerning these Terms with sufficient detail to identify the issue and the relevant enquiry or transaction.
